Example letters of consent

When you change the name of a child you will need to show either the original Deed Poll or a certified copy of the Deed Poll to all those who hold records of your child so that his or her name records can be amended.

As well as the Deed Poll you must also in many cases provide a letter of consent. This is a letter signed by all those with parental responsibility for the child, giving their consent to the change of name.

There are three example letters provided here and the one you should use depends upon whether you have sole or joint parental responsibility. To read more about this please see our FAQ 'What is parental responsibility and who has it?'

1. Sole Parental Responsibility
If you have sole parental responsibility a letter of consent produced and signed just by you will be sufficient. See example letter 1 below.

2. Joint Parental Responsibility – all consent to the child’s change of name
If you share joint parental responsibility the other person must also sign the letter of consent. See example letter 2 below.

3. Joint parental responsibility – the other person has not provided consent
If you cannot trace someone who shares joint parental responsibility and therefore you do not have their consent to change the child's name, we provide example wording for a letter that you may produce in order to explain this situation - See example letter 3 below.

However, if this is the case, or if you have contacted the other person and they have refused to give consent, it may be necessary for you to apply for a Court Order for permission to change your child's name.

Please use these letters as a guideline, but it is your responsibility to ensure that the statements made in your letter of consent are true and correct.

Example letter 1– Sole Parental Responsibility

I the undersigned, have sole parental responsibility for insert child’s old name in full, and hereby give consent to his/her change of name to insert child’s new name in full.

Include one of the following four statements only if you have sole parental responsibility and you are the child’s mother.

If the child was born in England or Wales:
I confirm that when the child was born I was not married to the child’s father nor was I subsequently married to him at any time after the birth. I also confirm that no other person has acquired parental responsibility either by agreement or by court order.

If the child was born in Northern Ireland:
I confirm that when the child was born I was not married to the child’s father. I also confirm that no other person has acquired parental responsibility either by agreement or by court order.

If the child was born in Scotland:
I confirm that when the child was conceived I was not married to the child’s father, nor was I married to him at any time after the conception. I confirm that the father is not recorded on my child’s birth certificate and I also confirm that no other person has acquired parental responsibility either by agreement or by court order.

Include this statement only if the other parent is deceased
I was married to the father/mother of my child, insert full name of the deceased but he/she sadly passed away on please insert date. I enclose a copy of the death certificate for your information and confirm that I now have sole parental responsibility.

I confirm that there is no court, custody or parental responsibility order preventing me from changing the name of the child named in this letter.

I enclose my child’s Deed Poll / a certified copy of my child’s Deed Poll, as evidence of my child’s change of name so please amend your records accordingly. I would appreciate the return of the Deed Poll document at your earliest convenience.

Example Letter 2 – Joint Parental Responsibility – all consent to the child’s change of name

We confirm that there is no court, custody or parental responsibility order preventing us from changing the name of the child named in this letter.

We enclose our child’s Deed Poll / a certified copy of our child’s Deed Poll, as evidence of the change of name so please amend your records accordingly. Please return the Deed Poll document at your earliest convenience.

If any person signing this letter does not live at the address shown at the top of this letter, please print their address under their name and signature.

Example Letter 3 – Joint Parental Responsibility – the other person has not provided consent

I the undersigned, have parental responsibility for insert child’s old name in full, and hereby give consent to his/her change of name to insert child’s new name in full.

The following is example text only – your letter must contain details of your own true and accurate circumstances. My husband and I were married when my child was born but he left in June 2001 and has had no contact with me or my child since then. He is no longer at his last known address. The Child Support Agency has been unsuccessful in finding him and relatives, mutual friends and previous employers do not know of his whereabouts.

Therefore, despite all my efforts it has not been possible to obtain his written consent to the change of name, but my son / daughter has expressed his / her own wish to change his / her name as shown above.

Only include this paragraph if appropriate and correct I have therefore applied for and been granted a court order allowing me to proceed with a change of name for the child named on this letter without the consent of the other party. I enclose a copy of the Court Order for your information.

Include this paragraph if appropriate and correct I confirm that there is no court, custody or parental responsibility order preventing me from changing the name of the child named in this letter.

I therefore enclose my child’s Deed Poll / a certified copy of my child’s Deed Poll, as evidence of the change of name so please amend your records accordingly. I would appreciate the return of the Deed Poll document at your earliest convenience.
